I authorize Ambit Marketing LLC (Ambit) to charge my credit or debit card entered above for the fees associated with a background check required by the state of New York to operate as an Independent Consultant and I authorize my card issuer to honor these charges. I confirm that I understand that the charge(s) associated with these fees is non-refundable. I agree to follow Ambit’s Payment Terms and Conditions regarding this payment. I agree that as an Ambit Energy Independent Consultant, I am an independent contractor, and not an employee, agent, partner, legal representative, or franchisee of Ambit Energy. I UNDERSTAND THAT I SHALL NOT BE TREATED AS AN EMPLOYEE OF AMBIT ENERGY FOR FEDERAL OR STATE TAX PURPOSES. I have carefully read and agree to comply with the Ambit Energy Independent Consultant Policies and Procedures, The Ambit Energy Independent Consultant Application and Agreement, The Ambit Energy Guide to Compensation, and The Ambit Energy Privacy Policy, all of which are incorporated into and made a part of this Consultant Application & Agreement. I understand that the Independent Consultant Application and Agreement, Independent Consultant Policies & Procedures, and Privacy Policy may be amended from time to time, and I agree that any such amendment will apply to me. Notification of amendments shall be published in official Ambit Energy materials. The continuation of my Ambit Energy independent business or my acceptance of commissions, bonuses or other benefits shall constitute my acceptance of any and all amendments.

I understand that I have the right to terminate this Agreement at any time, with or without reason. I understand that such termination must be in writing. I understand and agree that Ambit Energy may terminate this Agreement at any time, with or without reason, upon written notice to me.

Any Marketing Consultant who enrolls as an Independent Consultant may cancel in writing within 3 days of the date the MC Application and Agreement is received at Ambit Energy (Start Date) and will receive a full refund.

I understand that the regulations of the state(s) in which I market may require that Ambit conduct a criminal background check on me. I agree to authorize Ambit to conduct a criminal background check, if required, using an outside agency. I understand that a criminal conviction is not necessarily a bar to my enrollment as an Ambit Independent Consultant. If Ambit requires me to undergo a criminal background check, I agree to pay the associated fee.

The State of NY imposes additional $95 to complete the [records search] for any person who has have ever lived in the State. If you answer YES to the question of whether you have ever live in NY, you authorize Ambit to charge [to your payment card] the additional $95 fee required in NY, in which case the total amount charged for the [records search] will be $100.75.

If you answer NO to the question of whether you have ever lived in NY but the [records search] indicates that you have lived in NY, you authorize Ambit to charge [to your paymet card] the additional $95 fee required in NY in a separate transaction after the [records search] has been completed.

Your "Agreement" with Ambit Marketing, LLC ("Ambit") is composed of the Independent Consultant Application, the Policies and Procedures, the Ambit Compensation Plan, and the Privacy Policy, as they may be amended from time to time pursuant to the procedures set forth therein. These contracts are incorporated by reference into one another and form your integrated agreement with Ambit.
